An article by Ryley Carlock & Applewhite Shareholder Mike Moberly titled “Am I My Brother’s Secret-Keeper? Contemplating the Recognition of a Sibling Testimonial Privilege” was published in the most recent issue of the American Journal of Trial Advocacy. In the first full-length article addressing the topic, Mike advocates the recognition of a testimonial privilege prohibiting the compelled disclosure of confidential communications between siblings. The article argues that given the critical role siblings often play in providing one another with a “listening ear” and therapeutic guidance, the recognition of a sibling privilege would be a logical outgrowth of both the psychotherapist-patient privilege adopted by the Supreme Court in 1996 and the parent-child privilege being recognized in a gradually increasing number of jurisdictions on similar therapeutic grounds.
