Biography

As a litigator, Lorena’s clients trust her to aggressively protect and advance their interests. She helps business leaders confront and resolve a wide variety of disputes in state, federal, and bankruptcy courts. Her clients include financial institutions, lenders, commercial landlords, commercial tenants, developers, professionals, and entrepreneurs.

Lorena is a passionate supporter of the Hispanic community. As a first-generation American whose first language is Spanish, Lorena grew up in the border town of Yuma, Arizona and spent significant time across the border in Ciudad Morelos, Baja California, Mexico. She is actively involved in Los Abogados and the Arizona Hispanic Chamber of Commerce.

Lender Representation in Contract Disputes. Lorena devotes a significant portion of her practice to representing financial institutions and lenders in commercial lending disputes. Her experience includes lender liability, breach of contract, enforcement and defense of commercial loan agreements, foreclosures on real and personal property, forbearance agreements, receiverships, loan restructuring, and collateral securitization. She has a strong track record of obtaining judgments against debtors and helping her clients collect those judgments through wage and money garnishments, domestication of judgments, sheriff’s sales, and similar means.

Insurance Defense.  Lorena has defended various product liability and professional liability claims including the successful defense of manufacturers, accountants, and design professionals.

Commercial Landlord/Tenant Disputes. Lorena routinely helps resolve disputes between landlords and tenants. For landlords, she enforces lease terms, renegotiates leases with tenants, and initiates lockouts when necessary. For tenants, she works to secure more favorable lease terms and intervenes when their businesses are adversely impacted by unreasonable actions by the landlord. 

Community Property Issues. Lorena has helped clients navigate complex issues related to Arizona’s unique community property laws.  She has successfully defended against the enforcement of foreign judgments in Arizona.

Lender Liability. Lorena has experience defending banks against lender liability claims including non-renewals of matured loans, fraud, and general negligence claims.

Bankruptcy Litigation. Lorena’s bankruptcy litigation experience includes representing lenders in nondischargeable adversary actions, seeking stay relief, and advising clients of their rights in bankruptcy.
